Sensoluma is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

Individual experiences and responses to sensory products vary. A product that is suitable for one person may not be suitable for another.

  • are consumer products and toys;

  • are not medical devices;

  • are not intended to diagnose, treat, cure, mitigate, or prevent autism, sensory processing conditions, anxiety, attention disorders, developmental conditions, or any other medical or psychological condition;

  • are not substitutes for medical advice, diagnosis, therapy, occupational therapy, behavioral therapy, or professional care; and

  • do not guarantee any particular developmental, behavioral, educational, emotional, or therapeutic result.

Questions about whether a product is appropriate for a particular child or individual should be discussed with a qualified healthcare professional, occupational therapist, educator, or other appropriate specialist.

We make reasonable efforts to display product colors, dimensions, textures, components, and other details accurately. However, product appearance may vary depending on screen settings, lighting, manufacturing batches, and other factors.

Product packaging, colors, or minor design details may occasionally differ from the images shown, provided the product’s essential characteristics are not materially changed.

All descriptions, prices, availability, and product specifications may be updated without notice. We may discontinue a product or limit the quantity available to any customer, location, or jurisdiction.

SECTION 3 — PRODUCT SAFETY AND SUPERVISION

Customers must read and follow all product descriptions, age recommendations, safety instructions, labels, warnings, and packaging information before allowing a child or other individual to use a product.

Age recommendations are provided for safety and suitability purposes. Do not provide a product to a child younger than the stated minimum age.

Some products may contain small parts and may present a choking hazard. Products carrying a small-parts warning must not be given to children under the age stated on the product page or packaging.

Unless the product is expressly designed and labeled for unsupervised use, responsible adult supervision is required.

Before each use:

  • inspect the product for wear, cracks, loose parts, tears, leaks, exposed filling, damaged batteries, or other deterioration;

  • discontinue use immediately if the product is damaged or defective;

  • follow all cleaning, charging, storage, and maintenance instructions.

Products should never be placed around the neck, mouth, nose, or other parts of the body unless they are specifically designed and clearly labeled for that purpose.

Sensory products should not be used to restrain a person, restrict breathing, interfere with circulation, or replace professional supervision.

Certain products may not be appropriate for individuals who chew, bite, ingest non-food items, experience seizures, have allergies, or have particular physical or developmental needs. Review the product information carefully and seek professional guidance when appropriate.

SECTION 4 — ORDERS

Placing an order constitutes an offer to purchase products from Sensoluma.

We may accept, reject, limit, or cancel an order for reasons including:

  • product unavailability;

  • suspected fraud or unauthorized payment;

  • pricing or product-information errors;

  • shipping restrictions;

  • quantity limitations;

  • safety or compliance concerns; or

  • inability to verify customer information.

An order is accepted only after we send an order confirmation or shipping confirmation indicating acceptance.

Payment must be authorized and successfully processed before an order can be fulfilled.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us to charge the total order amount, including applicable taxes, shipping charges, and other disclosed fees.

Please review your order carefully before submitting it. Once processing begins, we may not be able to change or cancel it.

If we reject, modify, or cancel an order, we will attempt to notify you using the contact details provided during checkout. Any refund due will be issued to the original payment method.

SECTION 5 — PRICES, TAXES, AND BILLING

Prices, discounts, promotions, and availability may change without notice.

The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.

Applicable sales tax will be calculated based on the order and shipping destination where required by law.

Unless otherwise stated, displayed prices do not include applicable sales tax, shipping charges, expedited-delivery charges, or other fees disclosed at checkout.

Promotional offers may have separate terms, expiration dates, exclusions, and eligibility requirements. If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

You agree to provide accurate and complete billing, payment, shipping, and account information and to update it when necessary.

You represent that:

  2. you are authorized to use the payment method;

  3. the payment provider will honor the charges; and

SECTION 6 — SHIPPING AND DELIVERY

Delivery dates are estimates unless expressly stated otherwise.

We will have a reasonable basis for any advertised shipping timeframe. If we cannot ship within the stated timeframe, or within the period required by applicable law when no timeframe is stated, we may contact you to obtain consent to a delay or provide a refund for the unshipped merchandise. We are not responsible for delays caused by:

  • incorrect or incomplete addresses;

  • carrier disruptions;

  • severe weather;

  • natural disasters;

  • government actions;

  • transportation interruptions;

  • high-volume periods; or

  • other events beyond our reasonable control.

However, nothing in this section limits any cancellation, refund, or delivery rights available under applicable law.

Unless otherwise required by applicable law, risk of loss transfers to you when the package is delivered to the shipping address provided with your order.

You are responsible for providing a complete and accurate delivery address.

SECTION 7 — RETURNS, REFUNDS, AND DEFECTIVE PRODUCTS

Returns, refunds, exchanges, and cancellations are governed by our Refund Policy.

Nothing in these Terms limits rights you may have under applicable federal or state consumer-protection law.

If a product arrives damaged, defective, incomplete, or materially different from what was ordered, contact us promptly and provide:

Do not allow a child to use a damaged, defective, leaking, broken, or incomplete product.

  • publicly display;

  • publicly perform;

No license or ownership right is transferred to you except as expressly stated.

Sensoluma’s name, logo, product names, designs, and slogans are trademarks or other protected identifiers of Sensoluma or its licensors.

Shopify’s trademarks remain the property of Shopify. Other names, logos, and trademarks appearing through the Services belong to their respective owners.

SECTION 10 — OPTIONAL THIRD-PARTY TOOLS

We may provide access to tools or services supplied by third parties that we do not control or monitor.

Such tools are made available on an “as is” and “as available” basis, subject to applicable law and the third party’s own terms.

Purchases made through our store are transactions directly between you and Sensoluma, not Shopify.

To the extent permitted by law, Shopify is not responsible for products sold by Sensoluma or for disputes, injuries, losses, refunds, or other claims arising from transactions between you and Sensoluma.

This license does not transfer ownership of your Feedback to us.

You represent that:

  • you own or control the rights necessary to submit the Feedback;

  • your Feedback is truthful and reflects your genuine experience;

  • you have disclosed any compensation, discount, free product, or incentive associated with the Feedback; and

  • your Feedback does not violate these Terms or the rights of another person.

You must not submit Feedback that:

  • contains false or misleading statements;

Some states do not permit certain warranty exclusions. Therefore, some exclusions in this section may not apply to you.

Nothing in these Terms excludes or limits an express written warranty or an implied warranty that cannot legally be disclaimed. SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Sensoluma and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Services or products.

This may include loss of profits, loss of revenue, loss of data, loss of savings, or replacement costs.

Our total liability for a claim relating to a product or order will not exceed the amount you paid for the product giving rise to the claim, except where a greater remedy is required by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, gross negligence where applicable, or personal injury caused by conduct for which liability cannot be waived.

Because some states do not permit certain limitations of liability, some limitations may not apply to you.

If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed where necessary.

The remaining provisions will remain valid and enforceable.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Sensoluma concerning the Services and replace prior agreements or communications concerning the same subject matter.

Any ambiguity will be interpreted fairly and not automatically against either party.

SECTION 23 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a merger, acquisition, restructuring, asset sale, corporate reorganization, or transfer of the Sensoluma business, subject to applicable law.

SECTION 24 — GOVERNING LAW AND CONSUMER RIGHTS

Sensoluma is operated by PMA Pay BV, a company registered in the Netherlands.

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, except where mandatory consumer-protection laws in your state or country of residence apply.

Nothing in these Terms deprives a United States consumer of non-waivable rights or remedies available under applicable federal or state law.

Any jurisdiction or venue requirement in these Terms applies only to the extent permitted by applicable law.

Because consumer, warranty, privacy, accessibility, arbitration, and automatic-renewal laws vary by state, Sensoluma should have this section reviewed by a qualified attorney before publication.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.
